Este aplica-se \u00e0s atividades ruidosas permanentes e tempor\u00e1rias e a outras fontes de ru\u00eddo suscet\u00edveis de causar inc\u00f3modo, designadamente:<\/span><\/p>\n<ol>\n<li aria-level=\"1\"><b>Constru\u00e7\u00e3o, reconstru\u00e7\u00e3o, amplia\u00e7\u00e3o, altera\u00e7\u00e3o ou conserva\u00e7\u00e3o de edifica\u00e7\u00f5es;<\/b><\/li>\n<li><span style=\"font-weight: 400;\">Obras de constru\u00e7\u00e3o civil;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Labora\u00e7\u00e3o de estabelecimentos industriais, comerciais e de servi\u00e7os;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Equipamentos para utiliza\u00e7\u00e3o no exterior;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Infraestruturas de transporte, ve\u00edculos e tr\u00e1fegos;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Espet\u00e1culos, divers\u00f5es, manifesta\u00e7\u00f5es desportivas, feiras e mercados;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Sistemas sonoros de alarme;<\/span><\/li>\n<li aria-level=\"1\"><b>Ru\u00eddo de vizinhan\u00e7a.<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Neste artigo vamos dar destaque \u00e0quelas que se dirigem \u00e0 conviv\u00eancia habitacional, nomeadamente, as obras no interior de edif\u00edcios habitacionais e o famoso ru\u00eddo de vizinhan\u00e7a.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As fontes de ru\u00eddo, aqui enquadradas, suscet\u00edveis de causar incomodidade, podem ser submetidas a licen\u00e7a especial de ru\u00eddo, a cau\u00e7\u00e3o ou medidas cautelares.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2>O que diz a lei do ru\u00eddo sobre o barulho dos vizinhos?<\/h2>\n<p><span style=\"font-weight: 400;\">Para que n\u00e3o haja equ\u00edvocos, a <\/span><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\"><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/decreto-lei\/2007-34526375\" target=\"_blank\" rel=\"noopener\">Lei Geral do Ru\u00eddo<\/a><\/span> <\/span><span style=\"font-weight: 400;\">define <\/span><b>ru\u00eddo de vizinhan\u00e7a<\/b><span style=\"font-weight: 400;\"> como aquele \u201cassociado ao uso habitacional e \u00e0s atividades que lhe s\u00e3o inerentes, produzido diretamente por algu\u00e9m ou por interm\u00e9dio de outrem, por coisa \u00e0 sua guarda ou animal colocado sob a sua responsabilidade, que, pela sua dura\u00e7\u00e3o, repeti\u00e7\u00e3o ou intensidade, seja suscet\u00edvel de afetar a sa\u00fade p\u00fablica ou a tranquilidade da vizinhan\u00e7a\u201d.<\/span><\/p>\n<figure id=\"attachment_2675\" aria-describedby=\"caption-attachment-2675\" style=\"width: 1430px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-2675 size-full\" src=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-diz-a-lei-do-ruido-sobre-o-barulho-dos-vizinhos.png\" alt=\"\" width=\"1430\" height=\"872\" srcset=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-diz-a-lei-do-ruido-sobre-o-barulho-dos-vizinhos.png 1430w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-diz-a-lei-do-ruido-sobre-o-barulho-dos-vizinhos-300x183.png 300w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-diz-a-lei-do-ruido-sobre-o-barulho-dos-vizinhos-1024x624.png 1024w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-diz-a-lei-do-ruido-sobre-o-barulho-dos-vizinhos-768x468.png 768w\" sizes=\"auto, (max-width: 1430px) 100vw, 1430px\" \/><figcaption id=\"caption-attachment-2675\" class=\"wp-caption-text\">Fonte: dre.pt<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">O per\u00edodo de refer\u00eancia para a <\/span><b>cautela<\/b><span style=\"font-weight: 400;\"> de comportamentos enquadrados nesta defini\u00e7\u00e3o situa-se entre as 23h e as 7h, o que significa que, se o teu vizinho produzir ru\u00eddo incomodativo neste hor\u00e1rio, as autoridades policiais podem ordenar a cessa\u00e7\u00e3o imediata de tal incomodidade. J\u00e1 entre as 7h e as 23h, as autoridades policiais podem apenas estabelecer um prazo para fazer cessar o ru\u00eddo. O n\u00e3o cumprimento da ordem de cessa\u00e7\u00e3o da incomodidade constitui contraordena\u00e7\u00e3o leve pun\u00edvel com coima.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nota que, a <\/span><span style=\"font-weight: 400;\">lei do ru\u00eddo <\/span><span style=\"font-weight: 400;\">n\u00e3o estabelece concretamente um per\u00edodo em que \u00e9 <\/span><b>proibido<\/b><span style=\"font-weight: 400;\"> fazer ru\u00eddo; apenas fixa dois per\u00edodos do dia, no que concerne \u00e0 atua\u00e7\u00e3o das autoridades quando confrontadas com queixas de ru\u00eddo de vizinhos.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Contudo, o C\u00f3digo Civil estabelece a possibilidade de oposi\u00e7\u00e3o \u00e0 produ\u00e7\u00e3o de ru\u00eddo vizinho, perturbador e inc\u00f3modo, sempre que tal facto coloque em causa o direito ao descanso e ao sossego.\u00a0\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2>Obras no edif\u00edcio<\/h2>\n<p><span style=\"font-weight: 400;\">No que diz respeito ao ru\u00eddo resultante de <\/span><b>obras no interior dos edif\u00edcios habitacionais<\/b><span style=\"font-weight: 400;\">, sejam obras de recupera\u00e7\u00e3o, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/remodelar-casa\">remodela\u00e7\u00e3o<\/a><\/span> ou conserva\u00e7\u00e3o, a <\/span><span style=\"font-weight: 400;\">lei do ru\u00eddo <\/span><span style=\"font-weight: 400;\">estabelece um hor\u00e1rio em que as mesmas podem ser realizadas, sem necessidade de licen\u00e7a especial \u2013 <\/span><b>Entre as 8h e as 20h, apenas nos dias \u00fateis. <\/b><span style=\"font-weight: 400;\">No entanto, em caso de obras urgentes, com o objetivo de evitar ou reduzir o perigo de produ\u00e7\u00e3o de danos a pessoas ou bens, estas limita\u00e7\u00f5es n\u00e3o se aplicam.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para al\u00e9m de fazer cumprir a norma hor\u00e1ria, o respons\u00e1vel pela execu\u00e7\u00e3o das obras deve ainda, afixar em local acess\u00edvel, informa\u00e7\u00e3o sobre a dura\u00e7\u00e3o prevista das obras e o per\u00edodo no qual se antecipa que ocorra maior intensidade de ru\u00eddo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As obras que violem estas normas \u201cs\u00e3o suspensas por ordem das autoridades policiais, oficiosamente ou a pedido do interessado, devendo ser lavrado auto da ocorr\u00eancia a remeter ao presidente da C\u00e2mara Municipal para instru\u00e7\u00e3o do respetivo procedimento de contraordena\u00e7\u00e3o.\u201d Neste caso, constitui-se contraordena\u00e7\u00e3o leve pun\u00edvel com coima.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2>O que fazer se a lei do ru\u00eddo n\u00e3o for cumprida<\/h2>\n<p><span style=\"font-weight: 400;\">Se priorizares a via diplom\u00e1tica, podes optar por conversar com o vizinho produtor de ru\u00eddo ou com o administrador do condom\u00ednio (se for o caso). N\u00e3o podes esquecer que, hoje podes estar na posi\u00e7\u00e3o de prejudicado, mas amanh\u00e3 podes ser tu a causar inc\u00f3modo aos vizinhos, mesmo que inconscientemente. Por essa raz\u00e3o devemos ser compreensivos.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Se fizeres isto e o inc\u00f3modo continuar, a solu\u00e7\u00e3o passar\u00e1 por contactar as autoridades, PSP ou GNR, para que estas possam fazer cessar o barulho (se este ocorrer entre as 23h e as 7h) ou estipular um prazo para o fazer (se este ocorrer entre as 7h e as 23h).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cabe \u00e0s autoridades comunicar a ocorr\u00eancia \u00e0 C\u00e2mara Municipal para que esta aplique as devidas coimas.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2674 size-full\" src=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-fazer-se-a-lei-do-ruido-nao-for-cumprida.jpg\" alt=\"lei do ru\u00eddo\" width=\"1018\" height=\"678\" srcset=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-fazer-se-a-lei-do-ruido-nao-for-cumprida.jpg 1018w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-fazer-se-a-lei-do-ruido-nao-for-cumprida-300x200.jpg 300w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2023\/01\/O-que-fazer-se-a-lei-do-ruido-nao-for-cumprida-768x511.jpg 768w\" sizes=\"auto, (max-width: 1018px) 100vw, 1018px\" \/><\/p>\n<p>&nbsp;<\/p>\n<h2>Coimas previstas na Lei do Ru\u00eddo Portugal<\/h2>\n<p><span style=\"font-weight: 400;\">No que se refere \u00e0s categorias aqui relatadas, o n\u00e3o cumprimento das normas estabelecidas na <\/span><span style=\"font-weight: 400;\">lei do ru\u00eddo<\/span><span style=\"font-weight: 400;\">, constitui contraordena\u00e7\u00e3o leve, \u00e0s quais correspondem as seguintes coimas:<\/span><\/p>\n<p><strong>Se praticadas por pessoas singulares:<\/strong><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">De 200 euros a 2.000 euros, em caso de neglig\u00eancia;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">De 400 euros a 4.000 euros, em caso de dolo.<\/span><\/li>\n<\/ol>\n<p><strong>Se praticadas por pessoas coletivas:<\/strong><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">De 2.000 euros a 18.000 euros, em caso de neglig\u00eancia;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">De 6.000 euros a 36.000 euros, em caso de dolo.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h2>Posso pedir indemniza\u00e7\u00e3o?<\/h2>\n<p><span style=\"font-weight: 400;\">Sim. No caso de tomadas tomas as medidas \u2013 conversa com o vizinho e o administrador e a comunica\u00e7\u00e3o \u00e0s autoridades \u2013 e, mesmo assim, a situa\u00e7\u00e3o inc\u00f3moda persistir, podes recorrer ao Tribunal ou a Julgado de Paz.
