A atribui\u00e7\u00e3o desta licen\u00e7a s\u00f3 acontece ap\u00f3s realizada uma inspe\u00e7\u00e3o ao im\u00f3vel por parte dos t\u00e9cnicos da C\u00e2mara Municipal onde verificam o cumprimento dos requisitos exig\u00edveis por lei.<\/p>\n<p>&nbsp;<\/p>\n<h2>Licen\u00e7a de Habita\u00e7\u00e3o versus Utiliza\u00e7\u00e3o<\/h2>\n<p>A Licen\u00e7a de Habita\u00e7\u00e3o e a Licen\u00e7a de Utiliza\u00e7\u00e3o s\u00e3o documentos legais distintos, embora comumente confundidos como tratando-se do mesmo documento. <strong>A diferen\u00e7a reside no conceito<\/strong>. A primeira \u2013 licen\u00e7a de habita\u00e7\u00e3o \u2013 atesta a habitabilidade de determinado im\u00f3vel, ou seja, indica que este se encontra pass\u00edvel de ser habitado porquanto re\u00fane as condi\u00e7\u00f5es exigidas pela lei. J\u00e1 a segunda \u2013 a licen\u00e7a de utiliza\u00e7\u00e3o \u2013 determina os fins para os quais aquele im\u00f3vel deve ser utilizado, separando-se em duas categorias: utiliza\u00e7\u00e3o para fins habitacionais ou para fins n\u00e3o habitacionais onde se insere o caso do com\u00e9rcio, servi\u00e7os e ind\u00fastria.<\/p>\n<p>&nbsp;<\/p>\n<h2>Em que situa\u00e7\u00f5es \u00e9 obrigat\u00f3ria a Licen\u00e7a<\/h2>\n<p>Qualquer im\u00f3vel destinado a <strong>fins habitacionais precisa ter uma licen\u00e7a de habita\u00e7\u00e3o<\/strong> emitida pela C\u00e2mara Municipal da localidade em que se insere, depois de realizada a devida inspe\u00e7\u00e3o para verifica\u00e7\u00e3o dos requisitos legais obrigat\u00f3rios.<\/p>\n<p>A apresenta\u00e7\u00e3o deste documento \u00e9 necess\u00e1ria nas seguintes situa\u00e7\u00f5es:<\/p>\n<ul>\n<li><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/vender-e-comprar-casa-tudo-que-precisas-saber\">Compra de um im\u00f3vel<\/a><\/span> \u2013 obrigat\u00f3ria a apresenta\u00e7\u00e3o no ato da escritura;<\/li>\n<li><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/vender-e-comprar-casa-tudo-que-precisas-saber\">Venda de um im\u00f3vel<\/a><\/span> \u2013 obrigat\u00f3ria a apresenta\u00e7\u00e3o aquando da assinatura do <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/contrato-promessa-compra-e-venda\">Contrato-Promessa de Compra e Venda<\/a><\/span> e, posteriormente, na Escritura;<\/li>\n<li><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/arrendar-casa\">Arrendamento<\/a><\/span> \u2013 os propriet\u00e1rios devem apresentar a licen\u00e7a no \u00e2mbito da celebra\u00e7\u00e3o do <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/contrato-de-arrendamento\">contrato de arrendamento<\/a><\/span>;<\/li>\n<li>Constitui\u00e7\u00e3o de <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/propriedade-horizontal\">Propriedade Horizontal<\/a><\/span> \u2013 obrigat\u00f3ria a jun\u00e7\u00e3o deste documento ao processo;<\/li>\n<li>Pedido de <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/credito-habitacao-tudo-que-tens-que-saber\">Cr\u00e9dito-Habita\u00e7\u00e3o<\/a><\/span>.<\/li>\n<\/ul>\n<p>Uma licen\u00e7a de habita\u00e7\u00e3o deve estar sempre em conformidade com o respetivo projeto de arquitetura. Isto quer dizer que se, entretanto, forem realizadas altera\u00e7\u00f5es ao im\u00f3vel, como por exemplo, a constru\u00e7\u00e3o de um anexo ou piscina ou aumento da casa, estas modifica\u00e7\u00f5es devem ser registadas num <strong>pedido de atualiza\u00e7\u00e3o da Licen\u00e7a<\/strong>, para que desta forma, as obras efetuadas se encontrem legalizadas.<\/p>\n<p>&nbsp;<\/p>\n<h2>Requisitos necess\u00e1rios para a obten\u00e7\u00e3o da Licen\u00e7a de habitabilidade<\/h2>\n<p>Os requisitos necess\u00e1rios para a obten\u00e7\u00e3o da licen\u00e7a est\u00e3o definidos na lei portuguesa, nomeadamente, no <a href=\"https:\/\/dre.pt\/dre\/detalhe\/decreto-lei\/38382-1951-289214\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">Regulamento Geral das Edifica\u00e7\u00f5es Urbanas<\/span><\/a>, aprovado pelo Decreto-Lei n.\u00ba 38382, de 7 de agosto de 1951.<\/p>\n<figure id=\"attachment_1696\" aria-describedby=\"caption-attachment-1696\" style=\"width: 1497px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1696 size-full\" src=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas.png\" alt=\"\" width=\"1497\" height=\"898\" srcset=\"https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas.png 1497w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas-600x360.png 600w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas-300x180.png 300w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas-1024x614.png 1024w, https:\/\/www.imovel.pt\/news\/wp-content\/uploads\/2022\/04\/Regulamento-Geral-das-Edificacoes-Urbanas-768x461.png 768w\" sizes=\"auto, (max-width: 1497px) 100vw, 1497px\" \/><figcaption id=\"caption-attachment-1696\" class=\"wp-caption-text\">Fonte: dre.pt<\/figcaption><\/figure>\n<p>De forma resumida, os requisitos incidem sobre quatro \u00e1reas espec\u00edficas: <strong>eletricidade, g\u00e1s, \u00e1gua e saneamento<\/strong>, que ser\u00e3o alvo de vistoria por parte dos t\u00e9cnicos da autarquia.<\/p>\n<p>&nbsp;<\/p>\n<h2>Como pedir uma Licen\u00e7a de Habita\u00e7\u00e3o?<\/h2>\n<p>O pedido de licenciamento para habita\u00e7\u00e3o tem que ser efetuado <strong>junto da C\u00e2mara Municipal em que o im\u00f3vel se insere<\/strong>, onde se pede o preenchimento de um requerimento. Cada C\u00e2mara tem o seu documento, m\u00e9todo e pre\u00e7o, e por essa raz\u00e3o, para mais informa\u00e7\u00f5es sobre o procedimento dever\u00e1s questionar diretamente na C\u00e2mara.<\/p>\n<p>Nota que, se estiveres para <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/imobiliario\/vender-e-comprar-casa-tudo-que-precisas-saber\">comprar uma casa<\/a><\/span> que ainda est\u00e1 em constru\u00e7\u00e3o, quem dever\u00e1 tratar de obter a licen\u00e7a \u00e9 o construtor.<\/p>\n<p>&nbsp;<\/p>\n<h2>Qual a validade da Licen\u00e7a?<\/h2>\n<p>A licen\u00e7a de habita\u00e7\u00e3o n\u00e3o tem data de validade, sendo apenas obrigat\u00f3ria a sua renova\u00e7\u00e3o <strong>no caso de existirem altera\u00e7\u00f5es na estrutura do im\u00f3vel<\/strong>. Acontecendo estas altera\u00e7\u00f5es, quando terminadas, deves solicitar uma nova licen\u00e7a junto da C\u00e2mara Municipal.<\/p>\n<p>&nbsp;<\/p>\n<h2>Exce\u00e7\u00f5es<\/h2>\n<p>Os im\u00f3veis cuja data de constru\u00e7\u00e3o seja anterior a 1951 n\u00e3o s\u00e3o obrigados a ter a licen\u00e7a de habita\u00e7\u00e3o, tendo em conta que a lei que a aprova entrou em vigor nesse mesmo ano.<\/p>\n<p>Se porventura, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.imovel.pt\/news\/financas\/heranca\">herdares<\/a><\/span> um im\u00f3vel que n\u00e3o disponha de licen\u00e7a dever\u00e1s tratar de a obter junto da C\u00e2mara Municipal.<\/p>\n<p>Ainda, e no caso do arrendamento, a obriga\u00e7\u00e3o de obten\u00e7\u00e3o de licen\u00e7a aplica-se tamb\u00e9m a im\u00f3veis constru\u00eddos antes de 1951.
